Terms of Service

These Terms of Service ("Terms") govern your access to and use of the optzi! service ("optzi!," the "Service"), operated by Side Quest Energy LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

optzi! provides cookie consent management tools, including a consent banner, cookie and tracker scanning, consent enforcement, and related analytics. We may update, improve, or modify features of the Service over time.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. You must be at least 18 years old and authorized to bind any organization on whose behalf you use the Service.

3. Subscriptions, billing, and renewals

• optzi! is offered on an annual subscription basis at $99 per year, which includes one website. Each additional website is $59 per year.
• Subscriptions are billed in advance and renew automatically each year unless cancelled before the renewal date.
• Payments are processed by our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for applicable fees.
• You can cancel your subscription at any time from your account or by contacting us. Cancellation stops future renewals; except as described in our Refund Policy, fees already paid are non-refundable.
• We may change our prices on a going-forward basis; any change will apply to your next renewal.

4. Refunds

New subscriptions are covered by a 7-day money-back guarantee as described in our Refund Policy, which is incorporated into these Terms.

5. Fair use

Each website included in your plan is subject to a fair-use limit of 750,000 pageviews per month. If your usage consistently exceeds this limit, we may contact you to discuss an appropriate plan.

6. Acceptable use

You agree not to misuse the Service, including by: violating any law; infringing the rights of others; attempting to gain unauthorized access to the Service or its systems; interfering with or disrupting the Service; or using the Service to transmit malicious code.

7. Your content and websites

You are responsible for the websites on which you install optzi! and for the lawfulness of your own data collection. You represent that you have the right to install optzi! on those websites. optzi! is a tool to help you manage consent; it does not constitute legal advice and does not guarantee compliance with any law or regulation.

8. Intellectual property

The Service, including its software, design, and content, is owned by Side Quest Energy LLC and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will ensure compliance with any legal requirement.

10. Limitation of liability

To the maximum extent permitted by law, Side Quest Energy LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms or if your account poses a security or legal risk. You may stop using the Service at any time.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States and the state in which Side Quest Energy LLC is organized, without regard to conflict-of-laws principles.
